The “NUDE” skincare brand talks for the first time about its case against Stella McCartney.

Until now, Nude skincare – the brand which was last week reported to be at loggerheads with the McCartney label over the use of the word “Nude” – has not spoken about its issues with Stella. A release today, however, made it clear that this one could run and run.

“In May 2008, when asked for permission to use the trade mark ‘Nude’ for a Stella McCartney perfume, Nude – though great admirers of Stella McCartney – respectfully refused as a Nude scent is forthcoming,” the statement said. “Nude considers the launch of ‘Stella Nude’ by L’Oréal to be a clear infringement of Nude’s trade mark. To protect their brand, Nude was forced to take the matter to the English High Court.”

The High Court ruled today that Nude had a “clearly arguable claim of trademark infringement against the Stella Nude perfume”, the statement went on but that Nude had not been granted an interim injunction to prevent the sale of the perfume whilst the case is pending.

The hearing is set to take place next year.
